Praha<\/p>\n\n\n\n<p><strong>V&nbsp;roce&nbsp;2024 vyjde v&nbsp;platnost nov\u00e9 za\u0159\u00edzen\u00ed ES pro strojn\u00ed za\u0159\u00edzen\u00ed. Na\u0159\u00edzen\u00ed nahrazuje st\u00e1vaj\u00edc\u00ed sm\u011brnici 2006\/42\/ES o strojn\u00edch za\u0159\u00edzen\u00edch a vytv\u00e1\u0159\u00ed r\u00e1mec pro uv\u00e1d\u011bn\u00ed bezpe\u010dn\u00fdch strojn\u00edch za\u0159\u00edzen\u00ed a souvisej\u00edc\u00edch v\u00fdrobk\u016f na trh EU a bude tak p\u0159\u00edmo z\u00e1vazn\u00e9 nejen pro \u010dlensk\u00e9 st\u00e1ty, ale jeho p\u016fsobnost se bude vztahovat i na v\u0161echny fyzick\u00e9 a pr\u00e1vnick\u00e9 osoby \u010dlensk\u00fdch st\u00e1t\u016f.<\/strong><\/p>\n\n\n\n<p>Nov\u00e9 na\u0159\u00edzen\u00ed mimo jin\u00e9 pokr\u00fdv\u00e1 rizika souvisej\u00edc\u00ed s digitalizac\u00ed a nov\u00fdmi technologiemi,&nbsp;a to \u00fapravou z\u00e1kladn\u00edch po\u017eadavk\u016f na ochranu zdrav\u00ed a bezpe\u010dnost a zaveden\u00edm povinn\u00e9ho posouzen\u00ed t\u0159et\u00ed nez\u00e1vislou stranou rizik plynouc\u00edch z&nbsp;pou\u017eit\u00ed ur\u010dit\u00fdch tzv. \u201crizikov\u00fdch\u201d skupin strojn\u00edch za\u0159\u00edzen\u00ed. D\u00e1le na\u0159\u00edzen\u00ed p\u0159in\u00e1\u0161\u00ed v souvislosti s digitalizac\u00ed tak\u00e9 v\u00fdhody pro v\u00fdrobce, kte\u0159\u00ed budou moci poskytovat n\u00e1vod k pou\u017eit\u00ed strojn\u00edho za\u0159\u00edzen\u00ed pouze v digit\u00e1ln\u00ed podob\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Pozitiva?<\/strong><\/h2>\n\n\n\n<p>P\u0159em\u011bnou sm\u011brnice v na\u0159\u00edzen\u00ed vznikne pr\u00e1vn\u00ed r\u00e1mec, kter\u00fd je p\u0159\u00edmo pou\u017eiteln\u00fd ve v\u0161ech \u010dlensk\u00fdch st\u00e1tech a jasn\u00fd pro v\u0161echny hospod\u00e1\u0159sk\u00e9 subjekty. Na\u0159\u00edzen\u00ed bude tak\u00e9 pokr\u00fdvat nov\u00e1 rizika spojen\u00e1 se vznikaj\u00edc\u00edmi technologiemi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Strojn\u00ed v\u00fdrobky s vysok\u00fdm rizikem<\/strong><\/h2>\n\n\n\n<p>Rada a Evropsk\u00fd parlament se dohodly na tom, \u017ee seznam \u201evysoce rizikov\u00fdch\u201c strojn\u00edch za\u0159\u00edzen\u00ed podl\u00e9haj\u00edc\u00edch povinn\u00e9mu posouzen\u00ed shody t\u0159et\u00ed stranou, jak jej Komise navrhla v&nbsp;<strong>p\u0159\u00edloze 1<\/strong>, bude rozd\u011blen do<strong>&nbsp;dvou \u010d\u00e1st\u00ed.&nbsp;<\/strong>Podle uveden\u00e9 dohody se bude toto povinn\u00e9&nbsp;<strong>posouzen\u00ed shody t\u0159et\u00ed stranou<\/strong>&nbsp;vztahovat pouze na \u0161est kategori\u00ed strojn\u00edch za\u0159\u00edzen\u00ed. T\u00edmto z\u016fst\u00e1v\u00e1 zachov\u00e1na mo\u017enost vlastn\u00edho posuzov\u00e1n\u00ed shody ze strany v\u00fdrobc\u016f u v\u011bt\u0161iny kategori\u00ed v\u00fdrobk\u016f, a o zapojen\u00ed subjekt\u016f posuzov\u00e1n\u00ed shody tak budou rozhodovat sami v\u00fdrobci v z\u00e1vislosti na tom, kter\u00fd postup posuzov\u00e1n\u00ed shody zvol\u00ed.<\/p>\n\n\n\n<p>Po pe\u010dliv\u00e9m posouzen\u00ed a konzultac\u00edch s relevantn\u00edmi z\u00fa\u010dastn\u011bn\u00fdmi stranami bude Evropsk\u00e1 komise tento seznam v\u00fdrobk\u016f, u nich\u017e bude z d\u016fvodu jejich slo\u017eitosti a potenci\u00e1ln\u00edch rizik, kter\u00e1 mohou p\u0159edstavovat, vy\u017eadov\u00e1no posouzen\u00ed specializovan\u00fdm subjektem, moci aktualizovat. T\u00edm bude zaji\u0161t\u011bna rovnov\u00e1ha mezi pot\u0159ebou zajistit co nejvy\u0161\u0161\u00ed \u00farove\u0148 bezpe\u010dnosti a&nbsp;pot\u0159ebou nevytv\u00e1\u0159et pro&nbsp;unijn\u00ed pr\u016fmysl nep\u0159im\u011b\u0159enou z\u00e1t\u011b\u017e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Elektronick\u00e1 dokumentace<\/strong><\/h2>\n\n\n\n<p>Na\u0159\u00edzen\u00ed dosahuje p\u0159im\u011b\u0159en\u00e9 rovnov\u00e1hy mezi&nbsp;<strong>elektronickou a ti\u0161t\u011bnou dokumentac\u00ed<\/strong>. Rada a Evropsk\u00fd parlament se toti\u017e v principu dohodly na tomto:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>standardem budou digit\u00e1ln\u00ed n\u00e1vody,<\/li><li>mo\u017enost poskytnut\u00ed n\u00e1vod\u016f v ti\u0161t\u011bn\u00e9 podob\u011b v okam\u017eiku n\u00e1kupu z\u016fstane zachov\u00e1na v p\u0159\u00edpad\u011b z\u00e1kazn\u00edk\u016f, kte\u0159\u00ed nemaj\u00ed p\u0159\u00edstup k digit\u00e1ln\u00ed kopii,<\/li><li>s ka\u017ed\u00fdm v\u00fdrobkem budou muset b\u00fdt poskytnuty z\u00e1kladn\u00ed bezpe\u010dnostn\u00ed informace.<\/li><\/ul>\n\n\n\n<p><strong>Oblast p\u016fsobnosti<\/strong><\/p>\n\n\n\n<p>V z\u00e1jmu pr\u00e1vn\u00ed jistoty tak\u00e9 Rada a Parlament vyjasnily oblast p\u016fsobnosti a definice navr\u017een\u00e9 Evropskou komis\u00ed. Zejm\u00e9na se dohodly, \u017ee&nbsp;<strong>nevylou\u010d\u00ed<\/strong>&nbsp;mal\u00e1 dopravn\u00ed vozidla pro osobn\u00ed pou\u017eit\u00ed nebo lehk\u00e1 elektrick\u00e1 vozidla, jako jsou&nbsp;<strong>elektrick\u00e9 kolob\u011b\u017eky<\/strong>&nbsp;a&nbsp;<strong>elektrokola<\/strong>, vzhledem k tomu, \u017ee jsou \u0161iroce vyu\u017e\u00edv\u00e1ny a mohly by b\u00fdt pro u\u017eivatele potenci\u00e1ln\u011b nebezpe\u010dn\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Zm\u011bna posuzov\u00e1n\u00ed shody<\/strong><\/h2>\n\n\n\n<p><strong><em>Postupy posuzov\u00e1n\u00ed shody strojn\u00edch v\u00fdrobk\u016f s v\u00fdjimkou ne\u00fapln\u00fdch strojn\u00edch za\u0159\u00edzen\u00ed<\/em><\/strong><\/p>\n\n\n\n<p>Za \u00fa\u010delem osv\u011bd\u010den\u00ed shody strojn\u00edho v\u00fdrobku s t\u00edmto na\u0159\u00edzen\u00edm v\u00fdrobce nebo jeho zplnomocn\u011bn\u00fd z\u00e1stupce a osoba, je\u017e provedla na strojn\u00edm v\u00fdrobku podstatnou zm\u011bnu, pou\u017eije jeden z postup\u016f posouzen\u00ed shody uveden\u00fdch v odstavc\u00edch 2 a 3.<\/p>\n\n\n\n<p>2.Je-li strojn\u00ed v\u00fdrobek strojn\u00edm v\u00fdrobkem s vysok\u00fdm rizikem podle p\u0159\u00edlohy I, pou\u017eije v\u00fdrobce nebo jeho zplnomocn\u011bn\u00fd z\u00e1stupce a osoba, je\u017e provedla na strojn\u00edm v\u00fdrobku podstatnou zm\u011bnu, jeden z t\u011bchto postup\u016f:<\/p>\n\n\n\n<p>a) EU p\u0159ezkou\u0161en\u00ed typu (modul B) podle p\u0159\u00edlohy VII, po kter\u00e9m n\u00e1sleduje shoda s typem zalo\u017een\u00e1 na intern\u00edm \u0159\u00edzen\u00ed v\u00fdroby (modul C) podle p\u0159\u00edlohy VIII;<\/p>\n\n\n\n<p>b) shoda zalo\u017een\u00e1&nbsp;na \u00fapln\u00e9m zabezpe\u010dov\u00e1n\u00ed kvality (modul H) podle p\u0159\u00edlohy IX.<\/p>\n\n\n\n<p>3.Nen\u00ed-li strojn\u00ed v\u00fdrobek strojn\u00edm v\u00fdrobkem s vysok\u00fdm rizikem podle p\u0159\u00edlohy I, pou\u017eije v\u00fdrobce nebo jeho zplnomocn\u011bn\u00fd z\u00e1stupce a osoba, je\u017e provedla na strojn\u00edm v\u00fdrobku podstatnou zm\u011bnu, postup intern\u00edho \u0159\u00edzen\u00ed v\u00fdroby (modul A) podle p\u0159\u00edlohy VI.<\/p>\n\n\n\n<p>4.Ozn\u00e1men\u00e9 subjekty vezmou p\u0159i stanovov\u00e1n\u00ed poplatk\u016f za posouzen\u00ed shody v \u00favahu specifick\u00e9 z\u00e1jmy a pot\u0159eby mal\u00fdch a st\u0159edn\u00edch podnik\u016f a na z\u00e1klad\u011b t\u011bchto specifick\u00fdch z\u00e1jm\u016f a pot\u0159eb p\u0159im\u011b\u0159en\u011b poplatky sn\u00ed\u017e\u00ed.<\/p>\n\n\n\n<p><strong><em>Postupy posuzov\u00e1n\u00ed shody ne\u00fapln\u00fdch strojn\u00edch za\u0159\u00edzen\u00ed<\/em><\/strong><\/p>\n\n\n\n<p>1.V\u00fdrobce ne\u00fapln\u00fdch strojn\u00edch za\u0159\u00edzen\u00ed nebo jeho zplnomocn\u011bn\u00fd z\u00e1stupce zajist\u00ed, aby p\u0159ed uveden\u00edm ne\u00fapln\u00e9ho strojn\u00edho za\u0159\u00edzen\u00ed na trh byla vypracov\u00e1na tato dokumentace: a) p\u0159\u00edslu\u0161n\u00e1 technick\u00e1 dokumentace, kter\u00e1 spl\u0148uje po\u017eadavky uveden\u00e9 v \u010d\u00e1sti B p\u0159\u00edlohy IV;<\/p>\n\n\n\n<p>b) n\u00e1vod k mont\u00e1\u017ei, kter\u00fd spl\u0148uje po\u017eadavky uveden\u00e9 v p\u0159\u00edloze X;<\/p>\n\n\n\n<p>c)EU prohl\u00e1\u0161en\u00ed o zabudov\u00e1n\u00ed se vzorovou strukturou uvedenou v p\u0159\u00edloze V.<\/p>\n\n\n\n<p>2.V p\u0159\u00edslu\u0161n\u00fdch p\u0159\u00edpadech v\u00fdrobce ne\u00fapln\u00fdch strojn\u00edch za\u0159\u00edzen\u00ed nebo jeho zplnomocn\u011bn\u00fd z\u00e1stupce zp\u0159\u00edstupn\u00ed p\u0159\u00edslu\u0161n\u00e9mu vnitrost\u00e1tn\u00edmu org\u00e1nu na z\u00e1klad\u011b jeho \u017e\u00e1dosti zdrojov\u00fd k\u00f3d nebo programovou logiku v technick\u00e9 dokumentaci uveden\u00e9 v odst.&nbsp;1 p\u00edsm. a), je-li to nutn\u00e9 pro schopnost org\u00e1nu ov\u011b\u0159it shodu se z\u00e1kladn\u00edmi po\u017eadavky na ochranu zdrav\u00ed a bezpe\u010dnost stanoven\u00fdmi v p\u0159\u00edloze III. N\u00e1vod k mont\u00e1\u017ei uveden\u00fd v odst.&nbsp;1&nbsp;p\u00edsm.&nbsp;b) a prohl\u00e1\u0161en\u00ed o zabudov\u00e1n\u00ed uveden\u00e9 v odst.&nbsp;1&nbsp;p\u00edsm.&nbsp;c) se p\u0159ilo\u017e\u00ed k ne\u00fapln\u00e9mu strojn\u00edmu za\u0159\u00edzen\u00ed, dokud nen\u00ed zabudov\u00e1no do kone\u010dn\u00e9ho strojn\u00edho v\u00fdrobku, a pot\u00e9 se stanou sou\u010d\u00e1st\u00ed technick\u00e9 dokumentace dan\u00e9ho strojn\u00edho v\u00fdrobku.<\/p>\n\n\n\n<p><strong><u>P\u0158\u00cdLOHA I<\/u><\/strong><\/p>\n\n\n\n<p><strong>Strojn\u00ed v\u00fdrobky s vysok\u00fdm rizikem<\/strong><\/p>\n\n\n\n<p>1.Kotou\u010dov\u00e9 pily (s&nbsp;jedn\u00edm nebo n\u011bkolika kotou\u010di) pro zpracov\u00e1n\u00ed d\u0159eva a&nbsp;materi\u00e1l\u016f s&nbsp;podobn\u00fdmi fyzik\u00e1ln\u00edmi vlastnostmi nebo pro zpracov\u00e1n\u00ed masa a&nbsp;materi\u00e1l\u016f s&nbsp;podobn\u00fdmi fyzik\u00e1ln\u00edmi vlastnostmi t\u011bchto typ\u016f:<\/p>\n\n\n\n<p>1.1.pily se st\u00e1lou polohou kotou\u010de p\u0159i \u0159ez\u00e1n\u00ed, s&nbsp;pevn\u00fdm stolem nebo podp\u011brou a&nbsp;s&nbsp;ru\u010dn\u00edm posuvem
